HOUSING PAID FOR BY THE COMPANY. DOES IT COUNT AS SALARY?

When a company rents a property and provides it to an employee, this benefit may be considered part of their remuneration, even if no direct cash payment is made.

This situation, known as remuneration in kind, may have implications for Personal Income Tax (IRS), Social Security contributions and payroll processing, depending on the conditions under which the accommodation is provided.

What is considered remuneration in kind?

Remuneration in kind refers to benefits provided by an employer that represent an economic advantage to the employee, even though they are not paid in cash.

One example is a company covering the rent of a property used as the employee's permanent residence.

Under the Portuguese Personal Income Tax Code, the use of housing provided by an employer may be considered employment income, falling under Category A.

Is Company-Paid Housing Subject to IRS and Social Security?

As a general rule, this benefit may be subject to Personal Income Tax and Social Security contributions.

However, until 31 December 2026, a tax incentive allows certain permanent housing benefits provided by companies to their employees to be exempt from IRS and Social Security contributions.

This exemption is subject to specific legal conditions and limits, particularly regarding the location of the property in Portugal and the reference values established by law.

Therefore, providing housing through a company does not automatically mean that tax is payable. Each situation must be assessed individually.

What If the Accommodation Is Temporary?

The tax treatment also depends on the purpose of the accommodation.

When housing is provided as the employee's permanent residence, it may constitute a remuneration benefit.

However, accommodation paid for by the company during a temporary business assignment may receive different tax treatment, provided that the expense is properly justified and documented.

What Precautions Should Companies Take?

Before covering an employee's housing costs, it is important to assess the rental agreement, the conditions of use of the property and how the benefit relates to the employment contract.

The applicable tax and Social Security treatment should also be confirmed, ensuring that the amounts are correctly reflected in payroll and any relevant reporting obligations.

A proper assessment helps prevent errors, unexpected costs and potential tax non-compliance.
